How much personal leave (sick leave) are my employees entitled to?
Personal leave includes sick leave, carer's leave and compassionate leave. The Fair Pay and Conditions Standard sets the minimum for all Victorian employees (other than casual employees) at 10 days’ paid personal (sick or carer's) leave per year. It also allows two days paid compassionate leave for a death, life-threatening illness or injury in the employee's immediate family or household.
When an employee has used all their paid personal leave (sick or carer's), up to two days unpaid carer's leave (per occasion) is available to care for their immediate family or household. Unpaid carer's leave is also available to casuals.
Paid personal leave accumulates from one year to the next. When employment ends, it is not paid out. Employees will be allowed more than the minimum listed here if their workplace agreement or contract of employment is more generous. If unsure, get professional advice or contact the Workplace Infoline.
